US EPA publishes details on proposed reporting and recordkeeping rule

As part of the Agency's approach to ensure a reasonable use and manufacturing of nanoscale materials, the US Environmental Protection Agency (EPA) has proposed an information gathering rule on nanomaterials already in commerce. On April 6, 2015, EPA published in that respect the detailed one-time reporting and recordkeeping requirements under the Toxic Substances Control Act (TSCA).

EPA pursues a twofold approach to avoid unreasonable risks to environment and human health associated with nanoscale materials. This approach includes premanufacture notifications for new nanomaterials as well as information gathering on new and existing nanomaterials.

The previously proposed reporting and recordkeeping rule (proposed on March 25, 2015) would require that companies that manufacture certain chemical substances already in commerce as nanoscale materials notify EPA of specific information, as we already reported here.

On April 6, 2015, EPA published the detailed regulation in the Federal Register, which is currently undergoing public consultation until July 6, 2015. During this period, a public meeting for detailed discussion of the rule will be hold. Afterwards, the rule will be reviewed considering the comments before a final regulation will be issued.
